Nearly a month after the Malaysian Immigration Authorities completed the implementation of their online company registration requirement, sources continue to report overall processing delays for companies sponsoring Employment Pass (EP) applications. Further to our March 14 blog and tweet on the developing subject, all companies who will sponsor foreign EP holders must first register with the newly-branded Expatriate Services Division (ESD) through a new online portal. While this registration process is ultimately designed to reduce processing times and increase the ease of filing EP applications, the surge of new company registrations into the system combined with ESD officials still becoming acclimated with the adjudication process has caused backlogs in applications.
As Malaysian companies must undergo this registration process before they can proceed with many EP-related filings or formalities, the backlog in ESD company registrations has consequently affected employers’ ability to bring EP-holders into Malaysia in a timely manner. Processing delays should continue to be expected for current and future ESD registrations and applications as the authorities learn and streamline their own application and adjudication process.
